
General Terms and Conditions of Airmax Cargo Budapest Zrt. for Air Freight Forwarding Contracts
1. The quotation of AIRMAX Cargo Budapest Zrt. has been calculated based on the parameters provided. Charges may vary depending on the actual cargo details if these differ from the parameters previously specified.
2. The quotation of AIRMAX Cargo Budapest Zrt. is valid in the specified currency, per kilogram, for standard (not requiring special handling or cargo inspection), non-dangerous, stackable commercial goods, unless otherwise explicitly stated in the quotation. If the shipment is subject to volumetric weight, freight charges shall be calculated based on volumetric weight rather than actual weight. For volumetric weight calculation, 1 cubic meter equals 167 kilograms.
3. The quotation of AIRMAX Cargo Budapest Zrt. is based on tariffs, fuel surcharges, and exchange rates valid on the date of issuance. If these change prior to execution of the transport, AIRMAX Cargo Budapest Zrt. reserves the right to adjust its charges accordingly.
4. AIRMAX Cargo Budapest Zrt. shall remain bound by its quotation for the period specified therein. In the absence of a specified validity period, the quotation shall remain binding until it is accepted immediately by the other party.
5. Deferred payment is only possible following a positive credit assessment. Otherwise, freight charges are payable prior to collection/delivery of the goods, against invoice, by bank transfer, bank card, or cash at our cashier. AIRMAX Cargo Budapest Zrt. reserves the right to use external debt collection agencies to recover outstanding receivables. All costs related to debt collection shall be borne entirely by the Shipper (Principal).
6. The goods must be packaged suitably for air transport and in compliance with the regulations of the destination country. Boxed shipments must be manually handleable, while palletized shipments must be forkliftable. For pallets weighing 150 kg or more, the cargo must be secured to the pallet with double cross-strapping in both directions. Improper packaging may result in damage to the goods, refusal of carriage by airlines, or penalties imposed by authorities in the destination country. Any additional costs, penalties, or repackaging costs arising from non-compliance shall be borne by the Shipper (Principal).
7. In the case of dangerous goods, packaging, labeling, and documentation must comply with the IATA Dangerous Goods Regulations (DGR) and are the responsibility of the Shipper (Principal). The Shipper (Principal) bears sole responsibility for accurately declaring the nature of the dangerous goods in writing to the air carrier. The Shipper (Principal) shall indemnify the air carrier against any direct or indirect damage or costs arising from handling or transport of such goods. In case of misdeclaration, the Shipper (Principal) shall pay compensation in addition to a misdeclaration fee as determined by the applicable airline conditions.
8. If mandatory security screening of the cargo cannot be carried out using X-ray technology due to size, special packaging, composition, or high density, alternative inspection methods may require opening the packages and may incur additional costs, which shall be borne by the Shipper (Principal).
9. Transit times provided are indicative and may vary depending on flight availability at the time of booking.
10. Shipments are transported on scheduled passenger flights (unless otherwise stated), where passenger baggage has priority over air cargo. For standard bookings, transport on booked flights is not guaranteed, and partial shipments may occur. In case of capacity shortages, express shipments always take priority over standard cargo. Short-term capacity issues may arise due to increased passenger baggage or urgent shipments such as life-saving medicines, human organs, human remains, live animals, perishables, or valuables. No claims can be made against the airline for delays or partial shipments under standard service.
11. For express shipments, if rebooking occurs for any reason, claims may be submitted to the airline for reimbursement of the difference between standard and express freight charges.
12. If failure to meet the delivery deadline is expected to result in significant financial consequences, it is recommended to select the highest available priority/express service, depending on route and airline.
13. The quotation of AIRMAX Cargo Budapest Zrt. does not include applicable value-added tax or any additional costs related to forwarding services (such as administrative fees, demurrage, waiting charges, storage fees, public charges, packaging, fumigation, handling, pickup or delivery costs, insurance), unless explicitly stated.
14. The quotation of AIRMAX Cargo Budapest Zrt. becomes automatically void if the cargo value exceeds USD 1,000 per kilogram of gross weight. In such cases, the shipment is classified as a valuable cargo (VAL) under IATA regulations, and applicable IATA tariffs shall apply.
15. It is recommended to arrange separate cargo insurance to cover potential damages. AIRMAX Cargo Budapest Zrt. will arrange insurance only upon written instruction from the Shipper (Principal) and at their expense. In the absence of insurance, compensation for cargo damage is determined according to applicable international conventions, which due to limited liability may cover only a small portion of the actual damage. Any claims arising from air transport must be submitted exclusively against the air carrier.
16. AIRMAX Cargo Budapest Zrt. shall not be liable for consequential damages under any circumstances.
17. AIRMAX Cargo Budapest Zrt. is entitled to pass on to the Shipper (Principal) any unavoidable and unforeseen additional costs incurred during execution of the forwarding order that are necessary to ensure safe delivery of the shipment.
18. Any additional costs arising from incorrect information provided by the Shipper (Principal) (e.g. demurrage, storage fees, inspection costs, penalties) shall be borne entirely by the Shipper (Principal).
19. Force majeure events in air transport (e.g. adverse weather conditions, natural disasters, war, strikes, political unrest, terrorism, technical failures, authority actions, flight cancellations) are beyond the control of AIRMAX Cargo Budapest Zrt., which therefore excludes liability for damages arising from such events.
20. Claims may not be offset or automatically deducted from invoices or other payment obligations towards AIRMAX Cargo Budapest Zrt. without prior written approval. Any claims for damages arising during contract performance may be submitted by the Shipper (Principal) in accordance with the Hungarian General Forwarding Conditions for the purpose of enforcement against the liable party.
21. The Shipper (Principal) acknowledges that international conventions govern air cargo transport and airline liability, including the Warsaw Convention, the Hague Protocol, and the Montreal Convention. As not all countries have ratified all conventions, different agreements may apply depending on the airline and route.
22. AIRMAX Cargo Budapest Zrt. operates exclusively in accordance with the Hungarian General Forwarding Conditions issued by the Association of Hungarian Freight Forwarders and the relevant provisions of the Hungarian Civil Code. The General Forwarding Conditions are available on the Association’s website (www.szallitmanyozok.hu/hu/dokumentumok).
